Maternity leave
A female Government servant covered by the applicable CCS leave provision and satisfying the prescribed conditions may be granted maternity leave for 180 days.
Leave salary
During admissible maternity leave, leave salary is equal to the pay drawn immediately before proceeding on leave.
Paternity leave
Eligible male Government servants with less than two surviving children may be granted paternity leave for 15 days, subject to the time window and conditions prescribed in the rules.
Not debited like ordinary leave
Maternity and paternity leave are special leave provisions and are not treated simply as a debit from Earned Leave in the same way as ordinary EL.
Surrogacy — important 2024 update
DoPT's 2024 amendment extended benefits for childbirth through surrogacy where the Government servant has less than two surviving children: both the surrogate mother and commissioning mother may avail 180 days maternity leave; the commissioning mother may avail 730 days CCL; and the commissioning father may avail 15 days paternity leave, subject to the rules.
Special maternity leave after loss of child
DoPT issued a 2022 provision for 60 days Special Maternity Leave in cases of death of a child soon after birth or stillbirth, subject to the official conditions.
Apply through the prescribed channel
Submit the leave application and supporting documents required by your department. In surrogacy, adoption or special maternity cases, additional proof may be required.
Check continuation with other leave
The CCS Leave Rules contain provisions for combining maternity-related leave with other admissible leave. Verify the exact continuation period and sanction for your case.
